On-Line Privacy
concerns focus on the protection of “customer identifiable” information
which an individual or other customer reasonably expects to be kept private.
As the term suggests, “customer identifiable” information is information
which can be associated with a specific individual or entity, including,
for example, a customer’s name, address, telephone number, e-mail address,
and other information about on-line activities that are directly linked
to them, including information provided by the customer when shopping
and/or making purchases over the internet.
Acceris Management and Acquisition LLC, d/b/a Acceris Communications has put in place the following On-Line Privacy
Policy to protect customer identifiable information. This Policy covers
Acceris Communications and its subsidiaries, and applies
to all customer identifiable information that Acceris Communications
obtains when a customer registers for or uses a Acceris Communications
on-line service, including visiting a Acceris Communications
owned and controlled web site (“Acceris Communications
web site”) and when shopping and/or making purchases
through the Acceris Communications Shopping Cart.
Collection and Use: Acceris Communications
will collect and use customer identifiable information for billing purposes,
to provide and change service, to fulfill customer orders, to anticipate
and resolve problems with your service, or to create and inform you of
products and services that better meet your needs. This means that Acceris
Communications may use your customer identifiable
information, in conjunction with information available from other sources,
to market new services to you that we think will be of interest to you,
but we will not disclose your customer identifiable information to third
parties who want to market products to you.
Disclosure: Acceris Communications will not
sell, trade, or disclose to third parties any customer identifiable information
derived from the registration for or use of a Acceris Communications
on-line service – including customer names and addresses – without the
consent of the customer (except as required by subpoena, search warrant,
or other legal process or in the case of imminent physical harm to the
customer or others) except as provided for below:
Acceris
Communications may disclose customer identifiable
information in special cases when Acceris Communications
has reason to believe that disclosing such information is necessary to
identify, contact or bring legal action against someone who may be violating
Acceris CommunicationsUser
Agreement or may be causing injury to or interference with (either
intentionally or unintentionally) Acceris Communications
rights or property, other Acceris Communications users, or
anyone else that could be harmed by such activities.
If you make a purchase from the Acceris Communications
Shopping Cart, the information obtained from your Order may be provided
to a distributor only to the extent necessary to fulfill such order.
If Acceris Communications includes your name and
any other customer identifiable information in a directory that Acceris
Communications creates from information Acceris
Communications receives as an on-line service provider,
Acceris Communications will give you the opportunity
to have your information excluded from that directory. However these directories
may contain information obtained from other sources not subject to this
Policy.
Passwords: At
certain places on the Acceris Communications network
of web sites customers are permitted to register and select a password.
This password allows Acceris Communications to save
certain customer identifiable information in a secure manner associated
with an individual customer in such a manner that such customer may return
to the web site and engage in transactions without being required to re-enter
the customer identifiable information.
Customer’s password will control access to customer’s account information.
Acceris Communications strongly urges customers not
to divulge their password to anyone. Acceris Communications
will never ask you for your password in an unsolicited phone call or in
an unsolicited e-mail. Customers are reminded to sign out of their Acceris
Communications password protected account and close
their browser window when the customer has finished their work. This is
to ensure that others cannot access customer’s personal information and
correspondence. Ultimately, Customer is responsible for maintaining the
secrecy of their password and/or account information.
